What Is Retrospective Planning Consent? Do I need Retrospective Planning Permission? 


Retrospective Planning Permission

 

If building works start and planning permission is required and has not been obtained, a retrospective planning permission will be required to regularise the development. A 'retrospective planning application' is essentially an application that is submitted in order to obtain planning permission for the development.

 

An owner or developer should never rely on a retrospective planning permission application to get unauthorised development approved.  Anyone doing this is taking a considerable risk and may face formal enforcement action.

If work has gone underway on a construction project, or if an infrastructure has been added to a residence that requires planning permission, a retrospective planning permission application may need to be filed to ensure that the development is regularized. It is important that if planning permission was not filed before the project went underway that a retrospective planning permission application is filed in order to avoid legal actions.

 

What is retrospective planning consent? This type of consent is needed in order to alter or change the infrastructure of a home or dwelling. While, some things do not require planning permission in order to be altered, there are still a lot of changes to a home that will require permission from the planning authorities.

 

Before doing any work on a home, it is vital that you ask yourself, do I need retrospective planning permission or planning permission in general. If you are unsure if your project requires permission, it is up to you to get in contact with the local planning authority. Failure to get the permission you require can result in legal actions, which can force you to remove the added infrastructure that was constructed onto your residence. If the project was started before getting planning permission you need retrospective planning permission.
